This policy organizes the existing website-use protections concerning materials, links, submissions and technical access. The separate Terms & Conditions address the agreement framework, and the Security notice contains the security guidance formerly presented on the old Website Policy page.
What is the purpose of the website?

The website provides information about True Blue Auctions and its services, auction opportunities and related resources. Use of the website is subject to the [tba_legal_link slug="terms-and-conditions"]Terms & Conditions[/tba_legal_link] and any additional rules applying to a particular feature or transaction. The website is not itself the complete sale agreement for every advertised auction.

What use of website materials is permitted?

The existing agreement authorizes viewing and downloading a single copy of website material for personal, non-commercial use. It also permits dealers to display material to their clients solely to facilitate a transaction with True Blue Auctions. These limited permissions do not transfer ownership or grant other licenses by implication, estoppel or otherwise.

Retain the copyright and proprietary notices on permitted copies. Material includes text, images, graphics, audio, video, data, scripts, software and other website content.

Who owns the content and trademarks?

Website materials are owned or controlled by True Blue Auctions or third parties who have licensed them. Copyright, trademark and other applicable protections remain reserved. The availability of a photograph, logo, recording or document for viewing does not make it free to republish or use commercially.

The existing agreement prohibits use of True Blue Auctions’ or third parties’ trademarks, logos and service marks without the express prior written permission of the relevant rights holder.

What copying, modification or reuse is restricted?

Except within the limited permission or as authorized by the rights holder or applicable law, the source agreement restricts sale, modification, preparation of derivative works, reproduction, public display, public performance, distribution and other public or commercial uses of the materials. It expressly includes unapproved summaries, image thumbnails, other websites, publications, databases, catalogs, compilations and networked uses.

The original contract also prohibits removal, deactivation, reverse engineering, modification, tampering with or obscuring digital watermarks. Ask for permission rather than assuming a search result or publicly viewable file authorizes reuse.

How can you request permission to reuse content?

Send a request to info@TrueBlueAuctions.com identifying the material, intended use and where it will appear. The existing agreement requires express prior written permission for uses outside the limited license. A request or lack of a response is not permission, and permission from True Blue Auctions cannot exceed rights it holds.

How are copyright complaints submitted?

The source agreement asks a person claiming infringement to provide:

  • A physical or electronic signature of the person authorized to act for the copyright owner.
  • Identification or description of the copyrighted work.
  • The location of the material claimed to infringe.
  • The claimant’s address, telephone number and email address.
  • A good-faith statement that the challenged use is not authorized by the owner, its agent or law.
  • A statement under penalty of perjury that the notice is accurate and that the sender is the owner or authorized to act for the owner.

PUBLICATION HOLD — owner/counsel confirmation required. Confirm that the postal address and copyright mailbox remain correct and monitored. A contact named in website terms is not proof of a current U.S. Copyright Office designated-agent registration or entitlement to a statutory safe harbor.

How reliable are auction and property descriptions?

The existing agreement states that website material may contain errors or inaccuracies and makes no general representation of accuracy, completeness, reliability or timeliness, except as separately and specifically provided for a sale. A photograph, dimension, estimate or general article should be considered alongside the auction packet and available inspections.

For bidding or purchase decisions, examine the actual property information, disclosures and applicable terms. A historical testimonial or past-auction page describes a past experience and is not an offer of the pictured property or a guarantee of a future result.

Which auction announcements or documents take priority?

The existing website agreement gives saleroom catalogs, addenda and announcements priority over inconsistent website descriptions. The inspected online real-property terms also give specified posted or auction-day announcements priority over advertisements and listings.

An online-only auction may use a different notice mechanism. Read the event’s order-of-precedence and amendment provisions rather than assuming that a generic website statement supersedes a signed agreement or undisclosed amendment.

Is website information professional advice?

The existing agreement states that advice received through the website should not be relied on for personal, medical, legal or financial decisions and recommends an appropriate professional for advice tailored to the individual situation. Articles, glossaries and calculators are informational resources, not a title opinion, appraisal, tax opinion or individualized legal engagement.

An auction consultation or estate-service discussion does not by itself create an attorney-client relationship or substitute for the authority required of a seller, executor, administrator or other representative.

What is prohibited when using the site?

The source agreement prohibits interfering with website operation or transactions, introducing harmful code, imposing an unreasonable or disproportionately large system load, impersonating someone, violating applicable law or infringing other people’s rights. Users remain responsible for their conduct and materials they submit.

Do not use website access to interfere with legitimate bidding, evade qualification requirements or misuse another person’s credentials. Transaction-specific misconduct rules also apply.

Are scraping, harvesting and automated collection permitted?

The existing agreement requires honoring robot-exclusion headers or similar mechanisms where present. Regardless of those mechanisms, it prohibits using automatic or manual devices or processes to compile identifying information about users, bidders or sellers, or to recreate a substantial portion of the site in original or modified form.

It also prohibits unreasonable loads and interference with website or transaction systems. This provision preserves the source restrictions; it does not assert that an exclusion file itself prevents access or guarantees security.

What applies to public submissions?

If True Blue Auctions provides a public area, the original agreement treats material posted there as non-confidential and makes the submitting user responsible for the content and the rights needed to post it. Users must not submit content infringing privacy, publicity or proprietary rights, unlawful content, threats or harassment, prohibited sexual material, unapproved commercial solicitations, chain letters, pyramid schemes or harmful code.

This conditional provision does not represent that a chat room, message board or public upload area is currently enabled. A private contact form is not converted into a public area by this policy.

What license does the existing agreement provide for public material?

For communications actually posted to a public area, the source agreement grants True Blue Auctions a royalty-free, perpetual, irrevocable, non-exclusive license to use, reproduce, modify, publish, edit, translate, distribute, publicly perform and publicly display the communication and the included trademarks, names or likenesses, alone or in compilations, in current or future media or technology, and to sublicense those rights through multiple tiers.

This license is not extended by this draft to private identity documents, bidder applications, seller files or payment information. The original agreement expressly contemplates separate terms for submissions made outside public areas.

PUBLICATION HOLD — owner/counsel confirmation required. Confirm whether a public-submission feature is actually used, and have counsel review the scope and assent to this retained license, including third-party likenesses and minors. Retain an appropriate license; do not silently delete the source protection or broaden it to private data.

How are public content, moderation and access handled?

The existing agreement states that True Blue Auctions does not screen communications in advance or undertake a general duty to monitor them. It reserves discretion to investigate a reported violation, edit, refuse or remove material, and expel users or prevent access for violations. It also permits disclosures necessary for applicable law, legal process or government requests.

The agreement does not endorse or guarantee the truth, accuracy or reliability of user communications or opinions. Reliance on another user’s material remains subject to that limitation and applicable law.

What happens to access or licensed copies after a violation?

The source agreement states that violating its provisions terminates permission to use the website and materials and requires destruction of copies made under the limited license. Registration provisions separately permit suspension or termination for inaccurate information.

Termination of browsing or account access does not by itself cancel a bid, purchase or unpaid contractual obligation. Preserve documents where law or a legitimate legal-preservation duty requires preservation; counsel should reconcile any destruction request with that obligation.

What about third-party links and bidding technology?

The existing agreement provides external links for convenience, not endorsement, and does not promise the content or accuracy of external sites. Separate providers may operate registration, bidding, payment, signing or other technology and may impose their own terms and privacy notices.

What limitations apply to availability, software and technical errors?

The existing agreement makes no warranty that the website will operate continuously or without error or that its server is free of harmful content. It disclaims responsibility for equipment or data-servicing costs resulting from use, to the extent the limitation is lawful. The complete website warranty, damages and indemnity provisions are retained for review in the [tba_legal_link slug="terms-and-conditions"]Terms & Conditions[/tba_legal_link].

If separately licensed downloadable software is made available, its actual license must be reviewed. The legacy software-license sentence is unclear and is not treated as proof of a currently offered software product.

What import, export and restricted-property obligations are addressed?

The existing terms require compliance with applicable export restrictions for software and technical materials and with import/export requirements for purchased property. They assign sellers responsibility for lawful export from the property’s location and buyers responsibility for lawful import into the destination, subject to the actual sale agreement and law.

Permits, duties, customs declarations, protected-species restrictions and cultural-property rules can affect a proposed transaction. The source agreement does not warrant that a permit will be available or that government purchase or pre-emption rights will not be exercised. Confirm the actual item, jurisdiction and current restrictions before bidding or arranging shipment.
